Waterside Properties Direct – Terms & Conditions

  1. Waterside Properties reserve the right to refuse a property listing if it is not considered suitable for inclusion on the Waterside Properties Direct website. In such instances, a decision to decline a property listing will be made within 7 days of the owner submitting it to the website and the listing fee refunded in full. Waterside Properties’ decision to decline a particular property is final and no correspondence will be entered into.

     

  2. We reserve the right to refuse a property listing on Waterside Properties Direct if it falls within the area covered by an estate agency office of Waterside Properties UK Limited.

     

  3. Waterside Properties reserve the right to suggest amendments to how a property has been described and represented by the seller (either through its description, its pictures or stated location). If the seller of a property does not accept these suggestions and, in the opinion of Waterside Properties, the manner in which the property is portrayed is considered to be misleading, untrue or unfair, then we reserve the right to withdraw the property from the website; in such instances, no refund of the listing fee will be offered.

     

  4. The seller is responsible for ensuring that the details submitted in respect of his or her home constitute a fair and reasonable representation and comply with relevant legislation concerning the sale and marketing of property.

     

  5. With effect from 14th December 2007, sellers of residential properties placing their home on the market are required to produce a Home Information Pack (HIP), and make it available to prospective purchasers from the time marketing of the property commences. There are some very exceptional circumstances where this requirement may not be the case, depending on such factors as the number of bedrooms within the property and whether the property has been continuously marketed prior to 30th June 2007; if you believe your property may be exempt from the requirement to provide a HIP, please contact Waterside Properties Direct prior to listing your home on our website. It is be the seller’s responsibility to ensure that they have one in place before their property is advertised on www.watersidepropertiesdirect.co.uk; by agreeing to our terms and conditions vendors of property in England and Wales hereby confirm that they have a Home Information Pack available to prospective purchasers as required by law.

     

  6. The seller is responsible for ensuring that he or she is not in breach of any existing estate agency agreement (such as sole agency or sole selling rights) that they may already have in place.

     

  7. Subject to the above terms and conditions, upon receipt of the agreed listing fee and submission to the website, Waterside Properties Direct undertake to include the property on the website until it is either sold or withdrawn.

     

  8. This website may contain links that make it easy for users to visit other websites. If the user leaves this site through a link to a website operated by a third party, Waterside Properties cannot be responsible for the protection and privacy of any information which users provide while visiting such linked sites, nor for the content or operation of those sites.

     

  9. The nature of the agreement between Waterside Properties and the seller:

    1. We may transfer all rights and obligations under this Agreement in circumstances where the seller’s rights under this Agreement are not materially affected.

    2. The seller may transfer all rights and obligations under this agreement to another person who has the legal right to sell the property following the completion of a new agreement.

    3. This agreement supersedes all previous agreements between the parties in respect of the property and may not be modified except in writing signed by both parties.

    4. If any provision of this agreement is held by any court or other competent authority to be void or unenforceable in whole or in part, this agreement shall continue to be valid as to the other provisions and the remainder of the affected provision.

    5. This agreement shall be governed by and construed in all respects in accordance with the laws of England and Wales and each party hereby submits to the exclusive jurisdiction of the courts of England and Wales.
